Operational Safety

The Department of Operational Safety is assigned to submit to the Board of Directors projects of normative acts on flight operations or issue reports concerning:

1. Operational safety of aircrafts and transport of dangerous goods including possession and transportation of arms, explosives, ordnance or any other products, substances or objects that might endanger the crew or passengers or the aircraft itself, or even that are detrimental to health, in conjunction with other Departments;

2. Measures to be adopted by companies providing air services to prevent their crew and maintenance and operation technicians, that have access to the aircrafts, from using narcotic or psychotropic substances which can produce permanent or temporary physical or psychological dependence;

3. Minimum standards of safety, performance and efficiency of air transport, to be met by air services providers in coordination with other Departments;

4. Standards and procedures for airspace control proposed by the Air Force Command, which have impact on operational safety;

5. Interpretation of international standards and recommendations related to the activities of its competence in the technical sphere, including omissions;

Participate, by resolution of the Board of Directors, in Technical Panels, Study Groups, Working Groups, and other similar events, national and international issues involving the jurisdiction of the Department of Operational Safety ;

Propose the revision of standards of operational certification based on national and international developments of operational safety regulation;

Certify, suspend, revoke or cancel certificates, approvals and authorizations related to the activities of its competence as well as the licensing of crew and ground staff and technical certificates of competency and medical fitness, observing standards and regulations, in particular:

1. Recognize the foreign certification pursuant to international agreements with other countries; and

2. Issue, suspend, revoke and cancel the certificate of the airline and civil aviation training centers;

Propose measures to the bodies concerning the implementation of standards and recommended practices of the International Civil Aviation Organization (ICAO), evaluating results and suggesting necessary changes to improve air services, notifying and publishing differences in the area of jurisdiction of the Department of Operational Safety, when appropriate;

Establish routines relevant to the operational surveillance in relation to flight operations, licensing of personnel, technical and medical fitness certificates of crew members and employees of airlines, general aviation and sport aviation;

Monitor the transport of dangerous goods on aircrafts departing from or that are destined to a Brazilian aerodrome or with an over flight of national territory, in conjunction with the Air Force Command in the case of explosives and ordnance;

Promote the seizure of goods and products for civilian aircrafts, which are at odds with the specifications;

Participate in negotiation, conduct exchanges and articulate, when determined by the Board of Directors, with foreign aviation authorities, to validate one another´s activities related to the activities within its jurisdiction;

Accredit under the standard established in specific individuals or entities, public or private, recognized expertise, in accordance with internationally recognized standards for civil aviation, for dispatch of decisions, opinions or reports that demonstrate compliance with the requirements for issuing certificates or certificates related to the activities of its competence as well as disqualify when deemed appropriate;

Conduct inspections, surveys, audits, operational flights monitoring, check flights of technical proficiency, tests and other procedures relevant to operational safety, including foreign aircrafts in the area of jurisdiction of the Department of Operational Safety ;

Coordinate, regulate, standardize and regulate the activities carried on by the Regional Units in technical areas of competence of the Department of Operational Safety ;

Assess operational models of aircrafts to be operated in Brazil, in coordination with the Department of Airworthiness ;

Analyze, give advice and take action as appropriate on recommendation of flight safety on the investigation of aircraft accidents and incidents;

Define the prerequisites, the minimum qualification and standard of training and recycling for the Inspectors of Civil Aviation of their area of competence;

Delegate, when necessary, any of its powers, except those which by their very nature or by statutory prohibition, can only be implemented privately, and

Perform other activities as assigned by the Board of Directors.
